The rules of the Herb Hunters Contest (hereinafter – Rules).
1.
General
1.1.

The Contest territory — Russia, Azerbaijan, Belarus, Bulgaria, Vietnam, Germany, India, Spain, Kazakhstan, Kyrgyzstan, Mexico, Moldova, Mongolia, Poland, Serbia, Slovakia, the USA, Tajikistan, Turkey, Uzbekistan, Ukraine, and the Czech Republic.
1.3.
The Contest is conducted by the organizer in the global network Internet on the website (domain): http://herbhunters.ru/. The platform for conducting the Contest (sending applications, evaluation, results announcement) is http://herbhunters.ru/.

1.4.
The Contest period (including the participation period, determination and/or announcement of the winner’s period): starts on April 1st, 2017 at 00.01 am and ends on June 5th, 2017 at 23.59 pm GMT+3 (inclusively). All the terms provided by the Rules are to be established based on GMT+3 (Moscow time), unless otherwise stated.
The participation period starts on April 1st, 2017 at 00.01 am and ends on May 15th, 2017 at 23.59 pm.
The winners’ announcement terms: June 5th, 2017. The winners’ announcement time: within the period of 14.00 to 23.59.
1.5.
The Rules define the group of people to take part in the Contest, the essence of the Contest task, the amount and form of award, the procedure and results announcement, as well as the procedure and time for obtaining the award (prize) for the results, as provided by the Contest task.
1.6.
The determination of the Contest winners (an awardee) is not random. The winners will be determined by the organizer in accordance with the present Rules.
The Contest is not a lottery or other risk-based game.
2.
The Contest participants
Any legally capable adult, resident of the Russian Federation or any other country may enter the Contest.
The number of participants is not limited.
3.
How to enter:
3.1.
Carefully read the Contest conditions and accept them by performing the required actions on the Contest website:
— take part in the quiz,
— complete the creative task in accordance with the Contest conditions,
— repost the quiz and creative task results in the social networks (listed on the website) using any method provided by the Contest website.
3.2.
Complete the creative task in accordance with the conditions provided in Section 7 of the Rules.
3.3.
Upon fulfilling the Contest conditions, participant is prohibited to:
3.3.1.
use login and password of another registered user, as it may mislead the organizer and other users about the participant identity;
3.3.2.
misrepresent personal information, including his/her age;
3.3.3.
post any information or materials, which:
contain state secret or any other secret protected by the law, including information on the third parties private lives;
contain appeals to perform terrorist or other illegal actions or publicly justify terrorism and/or other illegal actions, other extremist materials;
contain elements of pornography, as well as of violence, cruelty, or illegal actions;
violate the religious feelings of the people;
contain elements of the minors being in danger to life and/or health, elements of consuming and demonstrating tobacco products and/or alcohol drinks;
provocative, rude, offensive, and aggressive; contradict to moral or ethical norms; may inflict any damage to the website and/or the organizer and its affiliates;
violate rights, including copyright, intellectual or exclusive third-party rights; contain offensive or nonconstructive criticism of the organizer, its affiliates and/or its employees;
violate other rights and interests of citizens and legal entities, requirements of the Russian Federation law or public ethics and morals;
3.3.4.
illegally use the objects, which are the intellectual property of the third parties;
3.3.5.
post texts and images, which promote consumption/production/distribution of drugs or psychotropics.
4.
The Contest prize
4.1.
The Contest prize: 10 trips to the Altai Territory of the Russian Federation.
5.
The rights and obligations of the Contest participants:
5.1.
The participant rights
5.1.1.
To examine the Contest Rules.
5.1.2.
To take part in the Contest in the manner specified by the present Rules.
5.1.3.
To claim the prize if the participant is announced as the Contest winner in accordance with the Contest Rules.
5.1.4.
To obtain information on the changes in the Contest Rules.
5.1.5.
Each participant may post unlimited number of works. One participant is entitled to one prize provided by the Rules, regardless of the number of works he/she posted. In order to post the second or subsequent works, the participant must perform anew all actions specified in clause 7 of the present Rules.
5.2.
The participant obligations
5.2.1.
To perform actions specified in the present Rules and applicable to the participant.
5.2.2.
The Contest participant, announced as a winner, must perform all actions within the period provided by the Contest Rules, in order to exercise his/her right to the prize.
5.2.3.
To entitle organizer to the rights to use the participant images, his/her personal data, pictures, interview, or other materials related to his/her participation in the Contest, for the purpose of conducting the Contest and giving the prize, as well as during the distribution of promotional information on the Contest for the unlimited period and without limitation of the territory, free of charge.
5.3.
The participant is prohibited to:
5.3.1.
misrepresent personal information, including his/her age;
5.3.2.
Upload and post any information or materials, which:
contain state secret or any other secret protected by the law, including information on the third parties private lives;
contain appeals to perform terrorist or other illegal actions or publicly justify terrorism and/or other illegal actions, other extremist materials;
contain elements of pornography, as well as of violence, cruelty, or illegal actions;
violate the religious feelings of the people;
contain elements of the minors being in danger to life and/or health, elements of consuming and demonstrating tobacco products and/or alcohol drinks;
contain unprintable words;
violate other rights and interests of the citizens and legal entities, requirements of the Russian Federation laws or public ethics and morals.
5.3.3.
Register more than one profile to take part in the Contest (double participation in the Contest).
5.4.
The Contest participant is subject to disqualification in case he/she violates any provisions specified in clause 5.3.
6.
The rights and obligations of the Contest organizers:
6.1.
The organizers obligations:
6.1.1.
To conduct the Contest in accordance with the present Contest Rules.
6.1.2.
To give the prize to the participant who has been announced as a winner in accordance with the Rules.
6.1.3.
To act as a tax agent in accordance with the requirements of the effective Russian Federation law on taxes and payments.
6.2.
The organizer rights:
6.2.1.
The Contest organizer exercises all the rights stipulated by the present Rules and the effective Russian Federation law.
6.2.2.
To refuse to give the prize to the participant, who has not performed the actions, requirements, or obligations provided by the Rules.
6.2.3.
To refuse to give the prize to the participant, who does not meet the requirements specified in the Rules.
6.2.4.
The organizer may, at its own discretion, not admit the Contest work to compete.
6.2.5.
The organizer does not consider the appellations related to the disqualification decisions.
6.2.6.
The organizer reserves the right to transfer information on the participant who has posted the work which violates the legislation and law-enforcement authorities regulations.
6.2.7.
The organizer has the right to make unilateral amendments to the present Rules (while complying with the requirements of Article 1058 of the Civil Code of the RF) with the publication of these amendments on the website specified in clause 1.3 of the Rules.
7.
The Сontest procedure
7.1.
The Contest participants must perform the following actions on the website specified in clause 1.3 of the Rules (hereinafter – Website):
enter the quiz by answering 5 questions;
follow the link «Join the Contest»;
complete a creative task by writing the text (prosaic or poetic) to continue the line: «I’m going to Siberia for herbs». The text shall be composed in English and shall not exceed the limit (250 characters including spaces). The phrase «I’m going to Siberia for herbs» is not included in the limit of 250 characters;
to fill in the mandatory fields with the participant’s contact details (full name, patronymic (if any)), contact phone number, personal e-mail) and insert a tick to accept the Contest conditions;
after performing the creative task and providing the contact details, re-post the quiz and the creative task results by using the tools provided by the website;
participants may delay the creative task after completing the quiz and reposting its results. In this case, he/she can fill in the fields with e-mail, full name, including patronymic (if any), and get a personal link to the specified e-mail in order to continue participation in the Contest. The personal link for participation will be valid only within the participation period specified in clause 1.4 of the Rules. In case of delaying the task, the participant is still obliged to re-post the creative task upon its completion.
7.2.
All participants’ works are subjected to mandatory moderation within two working days (based on the organizer’s working hours) after the participant has made a re-post.
7.3.
The works that have not passed through the moderation process are not allowed to participate in the Contest.
7.4.
Plagiarism (using other person’s idea for the task performance) is undesirable and can lead to disqualification of the work.
7.5.
The period of the winners’ determination, according to the results of the Contest, is mentioned in the «The winners’ announcement terms», clause 1.4. The winners are determined by judges decision. Judges are the team of Organizer’s employees (hereafter – Judges).
7.6.
The Judges are selected in accordance with the Director’s order of the Organizer company «On selection and work of the Herb Hunters Contest judges». The order determines the number of the Judges and their chairman as well as the voting procedure. The results of the Judges sessions/voting are drawn up by the relevant protocol and are an integral part of the Herb Hunters Contest documentation.
7.7.
The winners’ determination by the Judges can be subjective and must not be debated.
7.8.
Upon conditions observance listed in Section 7 of these Rules, the texts authors may be announced as winners by decision of the Judges. The present Rules determine ten prizes for ten winners of the Contest (one prize per winner). If the number of participants amounts to more or less than ten people, but hereby, the number of participants who have complied the conditions of Section 7, is not exceed ten people, then the number of winners can be determined in quantities of less than ten people.
7.9.
The results of the Contest and are final and cannot be appealed, except the following cases:
revealing the winner’s violations of the participation procedure and rules during the Contest by the organizer after the Contest results announcement;
winner’s refusal to perform the actions, which are necessary to get the Contest prize in accordance with the Rules, or winner’s refusal to receive the prize in accordance with clause 9.3.6. of the Rules.
In the above-mentioned cases the Judges determine the additional winner(s) among the persons taking part in the Contest according to clause 7.6 of the Rules.
7.10.
The results announcement takes place within a period, specified in clause 1.4 of the Rules, and according to the procedure specified in Section 8 of the Rules.
7.11.
All the participants pay all their expenses occurred from the participation in the Contest by themselves (including without limitation, the Internet access expenses).
8.
The notification procedure of the Contest winner
8.1.
The determination of the Contest winner is conducted according to the procedure, specified in Section 7 of the Rules.
8.2.
The winner notification on the victory is conducted via corresponding post on Website within the deadlines specified in clause 1.4 of the Rules.
8.3.
The organizer sends an email to the participant, announced as a winner, to the email address provided within the Contest period. In response letter the Participant is obliged to inform the organizer with the following data (including but not limited to): his/her last name, first name, patronymic (if any), registration address, residence address on the territory of the Russian Federation or other country, email address and telephone number. The provided last name, first name, patronymic (if any) must correspond to the personal account (profile) data on the website, specified in clause 1.3. A participant is obliged to send a response letter to the organizer within one calendar week after the notification receipt about victory from the organizer via email. All personal information of the participant provided to the organizer shall not be transferred to any third party.
8.4.
After verification of the Contest Rules and conditions compliance, listed in Section 7, the representative of the organizer sends an email to the winner, providing the information about procedure of prize obtaining. The prize shall not be granted if the Contest participant (winner) does not comply with the present Rules.
8.5.
The organizer is not obliged to send any messages to the participants who do not comply with the Contest Rules and conditions.
8.6.
The Contest winner is responsible for an accuracy of the provided information which is required for prize obtaining.
9.
The procedure of obtaining the prize
9.1.
The prize is a trip to the Altai district of the Altai Territory, the Russian Federation, which is paid by the organizer. The duration of the trip is one week within the period of July 1-31, 2017.
9.2.
The exact dates of the trip are determined only by the organizer of the Contest. The trip dates, approved by the Contest organizer are not be debated or changed.
9.3.
The trip includes:
9.3.1.
Refund of ticket cost from the place of winner residence on the territory of the Russian Federation to Novosibirsk, or from the place of arrival to the territory of the Russian Federation (for winners living outside the Russian Federation) to Novosibirsk and back if the cost does not exceed 30 000 rubles. If the cost exceeds 30 000 rubles, the winner pays the remaining sum on his/her own. Then, the winner pays his/her cost in full, and the organizer compensates for the value of the tickets in cash, provided that the winner has documents confirming the expenses on purchase of tickets and the tickets themselves. This Contest is paid at the time of meeting of the winners for transferring them to the place of accommodation during the trip period.
9.3.2.
Transfer of winners from the city of Novosibirsk to the place of accommodation during the period of trip (Altai district of the Altai Territory) and back.
9.3.3.
Accommodation in single, double rooms (depending on available rooms) of the tourist center «Pechki-Lavochki», located in the Altai district of the Altai territory.
9.3.4.
Three meals daily within the period of the trip.
9.3.5.
Four single-, two-day tours around the settlements of the Altai territory and the Republic of Altai which involve changing place of accommodation with maintaining the same living conditions.
9.3.6.
Daily (except arrival and departure days and weekends) organized hikes outside the territory of the tourist center «Pechki-Lavochki», located in the Altai district of the Altai territory. The hikes are aimed at studying healing herbs growing in Siberia (Altai region) with a specialist.
Note № 1. If it is physiologically impossible to the winner to take part in the trip (the acute, chronic diseases, muscle-skeleton disorder or other similar reasons), the winner may not transfer the prize to the third party. In this case the winner is deemed to have waived in obtaining the prise.
Note № 2. The rules of conduct, rights and obligations of the winner during the trip are provided by separate document of the organizer. The document is to be sent to the winner a few days before the trip starts.
Note № 3. The prize winners are responsible for their medical insurance and accident insurance, as well as any other type of life, health or liability insurance during the trip. The organizer is not responsible for the life and health of the prize winners within the period of the trip.
9.4.
To obtain the prize, a winner shall provide the organizer with all the information required for booking an accommodation at the tourist center «Pechki-Lavochki», which is located in the Altai district of the Altai territory: passport data, visa (if it is required by the country legislation of the winner for the entering the territory of the Russian Federation).
9.5.
If the winner has not provided contact information such as a phone number or email address, as well as in cases when there is no callback for more than 5 (five) business days on the given contact information, the organizer reserves the right to cancel the results of the Judges decision concerning this participant and consider another participant as the winner according to the clause 7.9 of the Rules.
9.6.
The expenses occurred from obtaining visa to the Russian Federation, insurance and other expenses, except those listed in the clause 9.3 are paid by the winner, not the Contest organizer.
9.7.
Replacement of prize with monetary compensation is not performed.
9.8.
The organizer acts as a tax agent in accordance with the Russian Federation law. According to the Russian Federation law, incomes not exceeding 4000 rubles received in the tax period from organizations, including gifts, prizes or prizes in contests, games and other events for the purposes of advertising goods, works, services are not subject to personal income tax (Personal Income Tax) (clause 28 of article 217 of the Tax Code of the Russian Federation). The organizer hereby informs the winners that it incurs the duty of the tax agent to submit information to the tax authorities on the income received within the framework of the Contest held, and to withhold and transfer of personal income tax. By participating in the Contest and accepting the Rules, the participants announced as winners are deemed to be duly informed of the above obligations of the organizer and are obliged to provide the organizer with their personal data necessary for processing documents and submitting information to the tax authorities on the income received by the winner within the framework of the Contest, and personal income tax.
10.
The method and procedure of participants notification on the Contest terms and conditions:
The notification Contest participants and potential Contest participants on participation conditions will be carried out on the Website specified in clause 1.3 of the Rules.
11.
Participation integrity. The winner’s refusal.
11.1.
The participants are not forbidden to participate in the Contest by using fraudulent or other inappropriate methods, in the sole discretion of the organizer, including (but not limited to) the following: use bots and other persons accounts, offer prizes and other incentives to other users or participants. The participants announced as winners will be tested against the right to take part in the Contest and the Rules compliance.
11.2.
If the winner refuses to provide the information specified in the clause 8.3, or the organizer isn’t able to contact the winner within 5 days or if the winner doesn’t comply with the Rules, the organizer has a right to disqualify such a winner and refuse to give him/her the prize. In case of the winner’s disqualification, the organizer has the right, at its discretion, to select another participant as the winner of the Contest in accordance with the clause 7.9 of the present Rules and give him/her the prize.
The winner agrees that the organizer and the persons appointed can disqualify the winner at any time, at their discretion, on the basis of any information specified, clarified or received as a result of the submission of the documentation by the winner, information materials or any other documents requested by the organizer, from which follows (or with sufficient probability may follow) violation of the Rules by the participant.
11.3.
The participant of the Contest has the right to refuse to receive the prize, as well as disclaim all the rights and obligations connected with its receiving, sending an email to the organizer or not arriving to Novosibirsk on the date the trip starts. In above-mentioned case the organizer has a right to dispose the prize at his own discretion. If the participant refused to get the prize, he/she can not claim it from the organizer afterwards. Claims for the prizes that were not received are not accepted.
12.
Miscellaneous
12.1.
The organizer reserves the right to post additional information about the Contest.
12.2.
By participating in the Contest, the participant understands and agrees that the organizer is not able to exclude the access of third parties (any other Internet users) to the results of the participant’s quiz and results on the organizer’s social network page and to prevent any undesirable actions of third parties toward the participant, the organizer does not bear any responsibility for the specified actions of third parties, as well as for any harm caused to the participant, including (but not limited to) harm to the personality, health, reputation of the Contest participant. The fact of participation in the Contest also means that the participant agrees that the organizer has the right to use his/her work (creative task) result in advertising and/or any other purposes without notifying the participant and without paying a fee. The organizer is obliged to specify the name of the Contest participant when using the result of the work (creative task) of the Contest participant.
12.3.
The organizer is not responsible for technical failures of the network provider or Internet provider of the participant; for actions/inactions of the network provider or Internet provider of the participant.
12.4.
If for any reason the Contest can not be carried out as planned, including the reasons caused by virus, Internet problems, defects, manipulations, unauthorized interference, falsification, technical malfunctions or any reason uncontrolled by the organizer that distorts or affects the performance, security, honesty, integrity or proper conduct of the Contest, the organizer may, in its sole discretion, cancel, terminate, modify, stop the Contest or to nullify any results of the creative task performed by the participants of the present Contest.
12.5.
The decisions of the organizer regarding the Contest procedures are final and not subject to revision.
12.6.
The fact of participation in the Contest means that the participant of the Contest gives his/her consent to the organizer, as well as to other consultants of the Contest organizer, who provides the tender (hereinafter referred to as «the Organizer» only for this clause of the Rules) for the processing of his/her personal data, that is gathering, systematization, accumulation, storage, clarification (updating, modification), use, blocking, deleting personal data by the Organizer exclusively for the purposes of this Contest in accordance with the requirements of the current Russian Federation law, as well as the placement of his/her personal data and information about his/her victory in the Contest in accordance with the clause 8.2 of the Rules. The consent of the participant to processing of his/her personal data by the organizer is free, concrete, informed and conscious. The consent to the processing of the personal data provided by the participant within the entire Contest period and until the expiration of 5 (five) years after its termination.
12.7.
The Participant has the right to withdraw his consent to the processing of the personal data at any time by sending a notification to the organizer by registered post with receipt to be acknowledged. Participants have other rights of the personal data subjects specified by the Federal Law of the Russian Federation No. 152-FZ of July 27, 2006. «On personal data» (hereafter the Federal Law «On Personal Data»). A participant’s withdrawal of the consent to the processing of the personal data automatically leads to his/her withdrawal from the participation in the Contest and makes it impossible to get the prize.
12.8.
The organizer has the right to refuse the winner/participant in such a prize or to demand its return (in cash), if the corresponding prize was claimed before the withdrawal of consent to the processing of personal data by the participant. The processing of the personal data will be carried out by the organizer in compliance with the principles and rules provided by the Federal Law «On Personal Data».
12.9.
Failure to provide or providing irrelevant (incorrect) and/or inaccurate (incorrect) personal data by the participant releases the organizer from the obligation to give the prize to the winner/participant and automatically results in the withdrawal of such participant from participation in the Contest.
12.10.
The definitions used in the present Rules refer only to the present Contest.
12.11.
All disputes regarding the present Contest shall be resolved basing on the current Russian Federation law.
